Yup, the ethical thing to do was to resign back in 2007, when Google started planning for Android. By sitting on the Apple board, Schmidt gained a lot of insight to Apple's technology, design features, and marketing strategy. Waiting until 2009 reduced his effectiveness on the board anyway as I'm sure he had to be excluded from certain discussions regarding competing areas.
