EFF's Attorney Talks About The Legality of Jailbreaking
We had reported in January that jailbreaking your iPhone may become illegal if DMCA exemption, which was granted back in 2010, expires.
Just like last time, Electronic Frontier Foundation (EFF) has taken the lead and has asked the U.S. Copyright Office to declare that jailbreaking does not violate the DMCA.
Gizmodo interviewed EFF staff attorney Mitch Stoltz to talk about the legality of jailbreaking. Here are some excerpts from that interview:

It's not about the ability to jailbreak but the factor of control. It's my phone, not yours. It deffinately doesn't belong to Apple any more so why do they want to dictate what I do with my device? Control.

It's more like buying a car and the auto manufacturers telling you which specific roads you can drive on, excluding routes that may take you close to competing dealerships. These contracts are unenforceable, they are just there so lawyers can make money.

It's simple for me, no jailbreak = no iPhone... Android can do out-of-the-box what iPhone does jailbroken...

Jailbreaking was not illegal before the exemption and it will not be illegal if the exemption fails to be renewed. The exemption simply clarified that it was not illegal.

Thank you Chris, I was about to post the same comment. WE jailbroke (is that the correct tense?) way before it was "deemed legal" and no one cared; is this just fodder to talk about now?

Apple Rumor---Apple intends to stop jailbreaking by putting encoding to crash the phones if the sw is tampered with in ANY way. Even if restored the phone will not work. If sent in under warranty to get a replacement, new tests are available for jailbreaking and it will be sent back to you.So if you want to have apple the bow to their Nazi tactic and do what you are told.
