number one, its an ipod 3rd gen show by the fact it has voice control as im pretty sure the 1st and second gens dont!! number two, it has a custom winterboard them, NO DOCK!, and finaly he reboots it to prove its an untetherd jailbreak. are you blind ??

Don't know anyone with a touch, a few with Nano's but that's it -
My phone updated itself to 3.1.3 yesterday and I cannot get into it as my phone needs to be unlocked as well as it is currently stuck with vodafone.
Is there anyway that I could use this hack, if i cant actually access the phone?
I am without a phone atm :(

So far, the only valid point that you may have and I don't think you even pointed this out is that we don't know what version OS is on that iPod touch. This video does indeed show a jailbroken iPod touch and it's funny that you can't seem to acknowledge that. Anyway, instead of making everyone annoyed why don't you paste some links to backup your rediculous claims?
